A. BACKGROUND

  1. The Australian Council for Health, Physical Education and Recreation (ACHPER) Australia (ABN 76 631 438 668) is the national governing body for health, physical education, recreation, and movement education in Australia. ACHPER manages and promotes various programs, events and activities, including professional learning, resources, and initiatives.
  2. ACHPER and each of the ACHPER State/Territory Branches (defined in clause 8 below) respects your privacy and is committed to the protection of your personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth) (Privacy Act).
  3. ACHPER may disclose your personal information to other ACHPER Branches and each ACHPER Branch may disclose your personal information to ACHPER or to other Branches, including for the purposes of enabling them to administer programs, events, and activities in their respective areas and provide related activities and services.
  4. When used in this Privacy Policy, depending on the context, “we,” “our,” and “us” refer to ACHPER Australia and/or the ACHPER Branches.
  5. Please read this Privacy Policy carefully as it describes how we collect, use, disclose and otherwise handle your personal information. It also describes how you may access your personal information, how you may request that your personal information be amended, how you can opt out of receiving marketing communications from us and how you can lodge a complaint in relation to how we are managing your personal information.
  6. Personal information is information or an opinion about an identifiable individual, or an individual who is reasonably identifiable. The information or opinion does not have to be true or recorded in a material form.
  7. In Australia, ACHPER programs, events and activities are implemented and conducted by a number of different organisations across the country. Accordingly, ACHPER has developed this privacy policy (Privacy Policy) to apply to each ACHPER Branch.
  8. For the purposes of this Privacy Policy, each of the following is an ACHPER Branch, and this Privacy Policy applies to each of these ACHPER Branches to the extent that they are required to have a privacy policy in place under the Privacy Act and have not adopted a separate privacy policy:
    • a) ACHPER Australia;
    • b) each of ACHPER’s related bodies corporate (as defined in the Corporations Act 2001 (Cth));
    • c) each State and Territory Branch, currently known as ACHPER ACT/NSW, ACHPER NT, ACHPER QLD, ACHPER SA, ACHPER TAS, and ACHPER WA (Branch Organisations).Please note the organisation now moving to the brand ‘Active Education Australia’ and still trading as ACHPER Victoria (ABN 23 911 016 643 | ARBN 677 215 904 ) resigned from ACHPER in October 2024, that organisation is not affiliated with ACHPER. 
    • d) each Affiliated Organisation, being those organisations (other than Branch Organisations) which are affiliated to ACHPER from time to time in accordance with ACHPER’s constitution.

      It is important to note that only organisations affiliated with ACHPER can be ACHPER Branches and use the ACHPER trademark. 

B. PERSONAL INFORMATION WE COLLECT

  1. The personal information we generally collect about you will depend on the primary purpose for which such information was collected. We may collect and hold various kinds of information about you in connection with our legitimate functions and activities, including:
    • a) contact information, such as your name, phone numbers, occupation, postal address, emergency contact details, email address and social media details;
    • b) your year/date of birth, age, gender, and professional credentials;
    • c) details of ACHPER programs or events that you have participated in and organisations with which you have participated;
    • d) copies of communications between you and us;
    • e) information regarding any outstanding payments owed by you to us;
    • f) other personal information provided voluntarily by you, for example, information provided in response to surveys or competitions;
    • g) payment and credit card details and purchasing preferences if you apply for membership, purchase goods or services, or make payments to us or our agents;
    • h) details of your academic qualifications, results, professional interests, reference checks, car registration and drivers licence details (if applicable), if you apply for employment or volunteer positions with us;
    • i) non-personally identifiable information, such as your IP address, browser type, web pages visited;
    • j) your membership history or professional accreditation details; and/or
    • k) other personal information relevant to our activities.
  2. Some of the information you give us may be required for us to assist you; with other information, it may be optional. If you do not provide some or all of the requested information, it may affect our ability to communicate with you or provide services, or your ability to participate in ACHPER programs or activities or apply for roles.
  3. Sensitive information is a subset of personal information that is generally afforded a higher level of protection, such as health information. We only collect sensitive information where necessary and with your consent or as required by law. Examples include:
    • a) details of a disability if relevant to service delivery;
    • b) details of your cultural background or language(s), if you elect to provide that information;
    • c) background checks (such as police checks, working with children checks) for employment, volunteer roles, or accreditation;
    • d) other personal information and emergency contacts if you participate in activities requiring such details.

C. HOW AND WHY WE COLLECT PERSONAL INFORMATION

We collect personal information to carry out our business, including to:

  • register you for programs or events;
  • manage memberships or accreditations;
  • deliver services or information you request;
  • manage employment or volunteer applications;
  • communicate with you, including for marketing or surveys.

We may collect information directly from you or from third parties such as:

  • ACHPER Branches or affiliates;
  • schools or educational partners;
  • event partners or suppliers;
  • referees for employment or accreditation checks.

D. HOW DO WE COLLECT PERSONAL INFORMATION FROM CHILDREN?

We may collect personal information regarding individuals under 18 from a parent, guardian, or responsible person. Please only provide such information if authorised to do so.

E. ANONYMITY AND PSEUDONYMITY

We will allow individuals to remain anonymous or use a pseudonym where lawful and practical (e.g., general enquiries). For most activities, however, we need identifying details.

F. FOR WHAT PURPOSES DO WE COLLECT, HOLD, USE, AND DISCLOSE PERSONAL INFORMATION

We use personal information to:

  • verify identity;
  • provide products or services;
  • communicate about events, resources, and opportunities;
  • administer memberships and programs;
  • conduct research or evaluations;
  • manage financial and legal obligations;
  • carry out marketing and promotions (with opt-out options);
  • engage with third-party providers and service partners.

G. OUR ONLINE SYSTEMS

We may collect data about your use of our websites, including via cookies and web beacons, to improve services and user experience. You can manage cookie preferences in your browser.

H. HOW DO WE HOLD PERSONAL INFORMATION?

We store information securely using trusted third-party providers, electronic systems, and paper-based files, and we apply appropriate security measures. We take steps to destroy or de-identify data when no longer needed.

I. WILL WE DISCLOSE PERSONAL INFORMATION TO OVERSEAS RECIPIENTS?

Some third-party providers may be located overseas. By providing your information, you consent to its disclosure overseas, understanding that privacy protections may vary.

J. ACCESS AND CORRECTION

You may request access to or correction of your personal information by contacting us (see Section N). We will respond within 30 days.

K. NOTIFIABLE DATA BREACHES SCHEME

If we experience a data breach likely to cause serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required.

L. OPT-OUT / UNSUBSCRIBE

You can opt out of communications at any time using unsubscribe options or by contacting us.

M. HOW TO MAKE A COMPLAINT

Please contact us (see Section N) if you wish to complain about a privacy matter. We will investigate and respond. If you are dissatisfied, you may contact the Office of the Australian Information Commissioner (www.oaic.gov.au).
